The UK immigration system recognizes the right to family life, but it fences this right behind high walls of financial thresholds and evidential burdens.

The Spouse and Dependent Visa routes are among the most rejected categories because they are subjective. The Home Office doesn’t just check your bank balance; they check the authenticity of your love.

The Financial Requirement (The Big Hurdle)

    The UK government recently increased the Minimum Income Requirement (MIR) for sponsoring a spouse (if you are a British/Settled person).

    • The Threshold: As of 2024, the sponsor must earn £29,000 annually (this figure is subject to phased increases up to £38,700).
    • The Proof:
      • Salaried: 6 months of payslips + bank statements.
      • Self-Employed: A full financial year of tax returns (SA302) and audited accounts. This is complex.
      • Savings Route: If you don’t meet the income, you can use savings. But the formula is high: £16,000 + (2.5 x Shortfall). For a full exemption, you need over £88,500 in savings held for 6 months.
    • Note: For Skilled Worker dependents, the requirement is much lower (maintenance funds), not the high MIR.

    Proving the “Genuine Relationship”

      The Home Office is cynical. They look for “Sham Marriages.” You must prove your relationship is real.

      • The Marriage Certificate: Is necessary, but not sufficient.
      • The Evidence:
        • Chat Logs: Samples of WhatsApps over the years (not intimate, but showing regular contact).
        • Photos: Wedding photos, holiday photos, photos with family.
        • Travel: Boarding passes of trips taken together.
        • Financial: Joint bank accounts or tenancy agreements (if you lived together previously).

      Unmarried Partners: You can apply without being married if you have lived together for 2 years akin to marriage. You need 2 years of cohabitation proof (utility bills in both names).

      The English Language Requirement

        The applicant (spouse) must prove they can speak English.

        • The Test: IELTS Life Skills A1 (for entry) or A2 (for extension).
        • Exemption: If they have a degree taught in English (requires Ecctis verification) or are from a majority English-speaking country.

        Accommodation Requirement

          You must prove you have a suitable place to live in the UK.

          • Overcrowding: The Home Office checks if the house is big enough. If you are sharing a 1-bedroom flat with 3 other people, you will be rejected.
          • Proof: Tenancy agreement or a letter from the landlord/parent allowing the spouse to stay.

          The Application Process

            • Location: Applied from outside the UK (Entry Clearance).
            • Timeline: Standard processing is 12-24 weeks (3-6 months). Priority services (30 days) are sometimes available for an extra fee.
            • The Interview: Rarely, the Home Office may interview the couple separately to test their knowledge of each other (“What is your husband’s favorite food?”, “What side of the bed does she sleep on?”).

            Dependents (Children)

              • Under 18: Can apply with the parent.
              • Over 18: Extremely difficult. Unless the child is disabled or in exceptional circumstances, adult children generally cannot come as dependents.
